Jones Act Rights

Once a seaman establishes his employer's liability, he then has the right to seek compensation for damages and losses suffered as a result of the maritime injury. Jones Act rights allow the seaman to seek recovery for economic loss such as past wage loss and loss of future earning capacity, and can also include loss of fringe benefits from time spent out of the workforce. In addition to economic damages, the Jones Act gives an injured seaman the right to seek compensation for physical pain and suffering and disfigurement as well as mental anguish resulting from the injury. Jones Act rights also include entitlement to receive compensation sufficient to cover future reasonable and necessary medical expenses.

A seaman's rights as established by the Jones Act are in addition to the rights and benefits to which he is entitled under General Maritime Law.
